GENERAL TERMS OF SERVICE
- GENERAL PROVISIONS.
- 1. The shipment of goods will always be carried out on behalf of the sender and/or recipient, as applicable in each case. Insurance coverage will only be provided based on written instructions received from them.
- 2. If the recipient does not take charge of all or part of the goods upon arrival, and no instructions are received from the Shipper within two hours of being requested, the goods will be stored at the expense and risk of the rightful owner, in compliance with the provisions of the law and, when necessary, in accordance with the commercial practices observed at the place of delivery.
- GOODS AND PACKAGING DESCRIPTION
Load orders for hazardous goods must be notified by the shipper at least 24 hours before the required deadlines for conventional goods. All shipments of hazardous goods must comply with ADR/IMDG regulations and, when necessary, any complementary legislation in force, including packaging, documentation, markings, waybills, and any other requirements necessary for the transport of such goods.
LINEA DIAGONAL INTERNACIONAL S.L.U. shall be expressly exempt from any liability arising from non-compliance with these requirements towards third parties. In case of omission or insufficient information, the shipper shall be held responsible for any damages caused by the goods, and Linea Diagonal Internacional, S.L.U. shall have the right to recover any expenses incurred as a result. Additionally, the company shall be exempt from any liability if the goods need to be unloaded, destroyed, neutralized, or rendered harmless as required by circumstances, without any compensation being owed to the shipper.
- RESPONSIBILITY
- 1 LINEA DIAGONAL INTERNACIONAL, S.L.U, shall not be held responsible for following any instructions issued after the transport documents have been generated, nor for any consequences arising from such subsequent instructions.
- LIMITATION OF LIABILITY.
- 1. The liability of Linea Diagonal, S.L.U. for loss or damage to goods shall be limited to the maximum amounts established by the applicable regulations:
- 1.1 For domestic transport, the limitation set forth in Article 57 of Law 15/2009 of November 11 on the contract for the carriage of goods by road shall apply, equivalent to one-third of the IPREM per kilogram of gross weight of the damaged, lost, or missing goods.
- 1.2 For international transport, the limitation set forth in the CMR Convention shall apply, corresponding to the applicable amount (€) per kilogram of gross weight of the missing, damaged, or lost goods.
- 1.3 LINEA DIAGONAL INTERNACIONAL, S.L.U shall not be liable for delays and/or failure to deliver goods within the agreed terms when such circumstances are attributable to subcontractors, as well as in cases of theft, force majeure, or when subcontractors engage in illicit, illegal, criminal, or any other unlawful activities. In such cases, full liability shall rest solely with the subcontracted company, expressly exonerating Linea Diagonal, S.L.U. from any responsibility.
- INSURANCE
The contracting party may subscribe to a supplementary insurance contract covering the value of the transported goods, subject to the prior declaration of their value and the payment of the corresponding premium.
- JURISDICTION
The sender and/or recipient submit to the jurisdiction and competence of the Courts of Vilafranca del Penedès (Barcelona), waiving any other jurisdiction that may apply.
All disputes of any nature between Linea Diagonal, S.L.U., its actual carriers, and/or its clients shall be submitted exclusively to the competent courts of Vilafranca del Penedès (Barcelona).
